What Happened:
I, was arrested at my home in Marion County, Oregon, on June 21, 2002, charged with molesting a young female child by Clackamas County's finest as they invaded my home. My house was searched and much property was taken that not only belonged to me but also my significant other, Bunny. They took hundreds of VHS movies I had copied over the years, numerous computers, personal and intimate toys, i.e., "The Tongue", camera's, personal photo's of family and friends. We were to realize much later that not all items seized were logged in. Yep Clackamas Counties finest must not paid enough as they apparently need to pocket items taken from a suspects home.
The growing of marijuana was legal. I was authorized to grow and posses under the Oregon Medical Marijuana Program (OMMP). Clackamas Counties finest intentially destroyed a legal medical marijuana grow operation.
When I presented the card to the Detective, he took the card and said "Now you don't have a permit" and proceeded to tear apart my grow room and dismantle the equipment. I was told they were gathering 'evidence' that could be turned over to Marion County for further prosecution. I was to find out later those charges would include manufacturing a controlled substance and child porn "found" on one of the computers that had clearly been unopened and deleted.
Plea bargains are geared for the guilty and I will go further into this later. As part of the numerous pleas offered by the Deputy District Attorney (DDA) in Clackamas County, each one sounding better than the last, always the promise that the Marion County charges would, poof, disappear. After turning down the last plea bargain offered on the morning of trial, October 23, 2003, "Take this deal for 75 months, register as a sex offender, and the Marion County charges will go away". (I found out later Clackamas County had already turned over to Marion County their evidence and May 21, 2003 a secret indictment for 11 counts of criminal offenses was issued after testimony from Clackamas County Detectives was heard.)
I was found guilty in Clackamas County by Court Trial November 5, 2003 and sentenced February 11, 2004 to two consecutive 100 month Ballot Measure 11 prison sentences by the Honorable Ronald D. Thom, Clackamas County Circuit Court Judge.
